1. Acceptance of Terms

By accessing or using any part of GotAI’s Services, including but not limited to submitting lead capture forms, scheduling appointments, interacting with our AI systems, or opting in to SMS updates, you agree to be bound by these Terms of Service and our Privacy Policy.

By voluntarily submitting your mobile number on any GotAI form or interface, you expressly consent to receive SMS communications from Revolutionary LLC for the following purposes: appointment reminders, promotional offers, service updates, product announcements, and support-related notifications. Message frequency may vary based on user engagement. Standard message and data rates may apply.

Consent to receive SMS is not a condition of purchase. You may opt out at any time by replying “STOP” and receive assistance by replying “HELP.” We store consent records (including timestamps and user source) for compliance with TCPA and A2P 10DLC requirements.

These Terms constitute a legally binding agreement between you (the user) and Revolutionary LLC, the owner and operator of GotAI. If you do not agree with these Terms, do not access, use, or interact with our Services in any way.

2. Changes to Terms

We reserve the right to update, modify, or revise these Terms of Service at any time, at our sole discretion. Any material changes to the Terms will be communicated through one or more of the following methods:

GotAI is a cloud-based software-as-a-service (SaaS) platform developed and maintained by Revolutionary LLC. Our Services include a suite of digital tools designed to help businesses automate marketing, streamline customer communication, and manage operations more efficiently. As part of these Services, users may send and receive SMS communications using registered A2P 10DLC numbers. These messages are subject to applicable carrier regulations, CTIA guidelines, and TCPA law. See Section 7 for details on consent, frequency, and opt-out procedures.

GotAI may offer integrations with third-party services (such as Google Calendar, Stripe, or Twilio), which are subject to their own terms of service. We are not responsible for service limitations, data breaches, or errors originating from those third-party systems.

We reserve the right to modify, suspend, or discontinue any part of the Services, including individual features or integrations, at any time with or without prior notice. Such changes may be made to improve system performance, maintain compliance, enhance security, or meet legal or regulatory requirements.

4. Eligibility

To access or use GotAI, you must be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is greater. By using the Services, you represent and warrant that:

By registering an account or submitting your information, you also affirm that all details provided are true, accurate, and complete, and that your use of the Services does not violate any applicable law or regulation.

5. Account Responsibility

You are solely responsible for maintaining the security and confidentiality of your account login credentials, including but not limited to usernames, passwords, API tokens, and any linked third-party integrations (e.g., Google Calendar, payment processors, or SMS providers).

You agree to:

You accept full responsibility for any outcomes resulting from such activity, including violations of applicable laws or platform rules.

We reserve the right to suspend or terminate access to your account if we detect or suspect abuse, unauthorized sharing, or violation of these Terms. You are also responsible for backing up any necessary data prior to termination.

6. User Conduct

By using GotAI Services, you agree to use the platform responsibly and in compliance with all applicable laws, industry standards, and carrier messaging policies. You further agree not to use the Services in any way that:

"Violates any local, state, national, or international laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and A2P 10DLC regulations."

"Sends SMS messages or campaigns to recipients without proper prior consent (opt-in) or without offering clear opt-out instructions such as “Reply STOP to unsubscribe.”

"Transmits or promotes any SHAFT content (Sex, Hate, Alcohol, Firearms, or Tobacco), adult or obscene material, or otherwise offensive, illegal, or deceptive content."

"Uses misleading headers, sender IDs, domain masking, or fake identities to misrepresent the sender or intent of any message."

Sends spam, bulk unsolicited SMS/email, phishing content, or other content that could be interpreted as abusive or harassing."

"Violates carrier rules, CTIA guidelines, or anti-spam policies of any platform or telecom operator."

"Uses GotAI Services to distribute malware, viruses, or other harmful code."

"Attempts to gain unauthorized access to any portion of the Services, or any data or systems of GotAI, its users, or its partners."

"Copies, reverse-engineers, disassembles, decompiles, or attempts to extract source code or proprietary logic used within the platform."

"Interferes with or disrupts the performance, integrity, or security of the Services or related systems."

"Uses AI automations or chatbot tools to impersonate real individuals, create fraudulent personas, or mislead recipients."

You are fully responsible for the content you distribute via our platform. Any violations of these guidelines may result in suspension or termination of your account, immediate reporting to mobile carriers, or legal action where applicable.

7. SMS & Communications

By submitting your phone number through any form on our website, platform, landing pages, or during the onboarding process, you expressly consent to receive SMS (Short Message Service) communications from GotAI, a product of Revolutionary LLC. This includes, but is not limited to:

"Appointment confirmations or reminders"

"Automated updates related to your account or interactions"

"Promotional offers and marketing campaigns"

"Lead reactivation or follow-up messages"

"Customer support or feedback requests"

All messages are sent via registered A2P (Application-to-Person) 10DLC messaging routes using carrier-approved platforms in compliance with:

"The Telephone Consumer Protection Act (TCPA)"

"CTIA Messaging Principles and Best Practices"

"U.S. carrier guidelines for commercial messaging"

7.1 Message Frequency & Cost

Message frequency may vary depending on your interaction with our Services. For example:

Users booking appointments may receive 1–3 confirmation/reminder texts.

Marketing subscribers may receive up to 4 promotional texts per month.

Standard message and data rates may apply, depending on your mobile carrier plan. You are solely responsible for any charges incurred from these communications.

7.2 Opt-In Consent

Consent to receive SMS is obtained via:

A clearly marked checkbox or opt-in form field at the point of data entry

A web form that includes a visible link to this Terms of Service and Privacy Policy

A disclosure near the submit button that reads:

“By submitting this form, you agree to receive text messages from GotAI. Message & data rates may apply. Reply STOP to opt out.”

7.3 Opt-Out Instructions

You may opt out of SMS communications at any time by replying with the word “STOP” to any message you receive. Once you opt out:

You will no longer receive further text messages unless you re-consent.

A confirmation message will be sent acknowledging your opt-out request.

7.4 Content Restrictions & Filtering Compliance

We do not send or support the transmission of SHAFT content (Sex, Hate, Alcohol, Firearms, or Tobacco). All campaigns are submitted for carrier vetting and adhere to brand and campaign registration rules mandated by The Campaign Registry (TCR) and wireless carriers.

Examples of prohibited SMS content include:

7.5 Third-Party SMS Providers

SMS messages may be delivered through third-party platforms integrated with our CRM and marketing software. We ensure that these vendors are:

Fully registered for A2P 10DLC compliance

Utilize proper encryption and opt-out management

Do not resell or misuse your phone number

7.6 Data Use & Privacy

All data collected through SMS or submitted via forms is handled according to our Privacy Policy. We do not sell, rent, or share your phone number with unrelated third parties for promotional purposes.

By interacting with GotAI, submitting your phone number, or using any feature that initiates SMS delivery, you acknowledge and agree to receive compliant SMS communications under the protections of U.S. law. You have full control to opt out at any time.

8. Payment Terms

Some features, tools, or premium services offered by GotAI may require payment. This section outlines how billing, subscriptions, and payment responsibilities are managed for both compliance and user protection.

8.1 Billing and Fees

By choosing to access or use any paid features of our Services, you agree to pay the applicable fees in accordance with the billing terms presented to you at the time of sign-up. Unless otherwise stated:

All payments are billed in advance, either on a monthly or annual basis.

Fees are non-refundable, except as required by law or expressly stated in a specific offer.

We reserve the right to change pricing at any time, with advance notice provided via email or in-app notifications.

Add-ons like expanded SMS volume or AI agent access

One-time setup, onboarding, or customization fees

8.2 Recurring Charges & Authorization

For subscription-based services, you authorize Revolutionary LLC (or our payment processor) to automatically charge your chosen payment method on a recurring basis (monthly or annually), until you cancel.

Recurring billing is clearly disclosed at checkout.

You will receive a confirmation email after each successful charge.

Payment will continue unless you cancel before your next billing cycle.

8.3 Accepted Payment Methods

We accept payments through secure third-party processors (such as Stripe or PayPal) and may offer additional methods such as ACH or credit/debit cards, subject to approval.

You must provide accurate and complete billing information.

You agree to update your payment details as needed to prevent service disruption.

8.4 Payment Processor Liability

All transactions are securely processed through trusted third-party platforms. While we take reasonable precautions, Revolutionary LLC is not liable for security breaches, errors, or delays caused by external processors.

You agree that:

8.5 Failed Payments and Suspension

No credits will be issued for unused time, subscription lapses, or partial months.

You are responsible for paying any applicable taxes, levies, duties, or similar government-imposed charges in connection with your purchases, based on your billing address or country of residence. If applicable, sales tax will be added to your invoice.

By subscribing to any paid Services offered by GotAI, you agree to the terms outlined above and authorize recurring billing where applicable. We aim for full transparency and compliance with industry-standard billing practices, including secure processing and opt-out rights.

9. Cancellation & Termination

You may cancel your account or subscription at any time by contacting us at [email protected]. Upon receiving your cancellation request, we will process the request within a commercially reasonable timeframe. Depending on your subscription plan or usage status, certain final charges or non-refundable fees may still apply.

For subscription-based services, cancellation will take effect at the end of your current billing cycle unless otherwise specified. You will continue to have access to the Services until the expiration of your paid period, after which your access will be revoked, and your data may be permanently deleted, unless required to retain it for legal, tax, or compliance purposes.

Our Right to Terminate

We reserve the right to suspend, restrict, or permanently terminate your access to the Services at our sole discretion, with or without notice, if we determine that:

You have violated any provision of these Terms, including misuse of SMS campaigns or spamming users.

You are using the platform for fraudulent, abusive, or prohibited activities (e.g., SHAFT content: Sex, Hate, Alcohol, Firearms, Tobacco).

You have attempted to interfere with or compromise the integrity, performance, or security of our platform or other users.

Your activity violates carrier regulations, CTIA guidelines, or A2P 10DLC campaign rules, which may lead to carrier blocks or account suspension by upstream providers.

We also reserve the right to suspend or terminate Services in response to legal requirements, court orders, or to prevent potential harm to our systems, users, or reputation.

Effect of Termination

Upon any termination (whether initiated by you or by us):

All licenses and rights granted to you under these Terms will immediately cease.

Your access to the platform and Services will be revoked.

Your user data and campaign activity (including contact lists, scheduled SMS messages, and workflows) may be deleted permanently without recovery.

We may retain limited user or transaction information to comply with legal, financial, or regulatory obligations (such as anti-spam, TCPA, or carrier audit records).

Reinstatement After Termination

If your access was suspended due to a violation, and you believe it was a mistake or have resolved the issue, you may request a review by contacting [email protected]. We do not guarantee reinstatement and reserve the right to deny access at our discretion.

10. Intellectual Property

All content, source code, AI workflows, design elements, branding materials, and other intellectual property related to GotAI are the sole property of Revolutionary LLC or its licensors. This includes, but is not limited to:

Website layouts, graphics, and custom design features

Automation flows, AI scripts, prompts, and workflows

CRM templates, campaign structures, and internal frameworks

Educational materials, documentation, and training guides

Logos, taglines, marketing copy, and branding assets

All backend code, logic, or proprietary logic sequences

These materials are protected under U.S. and international copyright, trademark, trade secret, and other intellectual property laws.

10.1 Prohibited Uses

You may not, under any circumstance, do any of the following without our express written consent:

Copy, reproduce, republish, distribute, or license any part of GotAI’s intellectual property.

Modify, adapt, translate, reverse-engineer, decompile, or create derivative works of any part of our Services.

Use any branding elements (logos, visuals, templates) for your own marketing or resale purposes.

Sell or sublicense our AI workflows, automations, codebases, or proprietary campaign structures.

Present yourself as the creator, owner, or representative of GotAI in any way that may mislead others.

Any unauthorized use of our intellectual property constitutes a material breach of these Terms and may result in immediate suspension or termination of your access to our Services, along with potential legal action.

10.2 A2P Compliance Enforcement

We explicitly prohibit the reproduction, resale, or sharing of our platform’s SMS or automation systems for the purpose of:

Evading A2P 10DLC registration

Sending unauthorized or misleading campaign traffic

Transmitting spam, SHAFT content, or messages from unregistered numbers or phone pools

Violations may result in reporting to telecom authorities, disconnection by upstream carriers, and full account termination.

10.3 Permitted Use

Subject to these Terms, GotAI grants you a limited, non-exclusive, non-transferable, revocable license to use our Services solely for your personal or business use in accordance with:

Your active subscription or account type

Usage limitations or access levels applicable to your plan

All carrier-level and federal compliance standards including A2P 10DLC, CTIA, and TCPA

You may view, interact with, and apply the Services within their intended use, but you do not gain any ownership rights over GotAI’s tools, assets, or systems.

10.4 Enforcement and Monitoring

GotAI actively monitors usage and reserves the right to suspend access or take legal action if it detects any of the following:

Unauthorized replication or resale of automation workflows or SMS templates

Sharing of internal templates, forms, or campaign assets without consent

Use of white-labeled versions of GotAI without explicit approval

AI-based scraping, replication, or reverse-engineering of protected workflows or branded elements

10.5 Third-Party IP and Disputes

You also agree to respect the intellectual property rights of third parties whose services or content may be integrated with the platform. If you believe your intellectual property rights have been infringed upon, contact us at:

11. Third-Party Services

11.1 Use of Third-Party Services

GotAI may integrate with or provide links to third-party services, tools, software, APIs, or platforms ("Third-Party Services") for your convenience. These may include, but are not limited to:

11.2 No Control or Liability

Revolutionary LLC does not own or control these Third-Party Services. As such:

We do not guarantee their reliability, accuracy, uptime, or continued availability.

We are not responsible for any damage, loss, or harm caused by the use of such third-party platforms.

Your use of them is entirely at your own risk, and you assume full responsibility for any issues that arise.

If a Third-Party Service experiences downtime, violates your privacy, or engages in unlawful conduct, you agree that your dispute lies directly with that provider—not with GotAI.

11.3 Data Sharing & Compliance

Some integrations with Third-Party Services may require data sharing, including customer contact details, SMS/MMS message content, calendar availability, or form submissions.

To remain fully A2P 10DLC-compliant, GotAI ensures that:

Any third-party messaging provider (e.g., Twilio) is carrier-registered for A2P traffic

All opt-in data passed through third-party forms is securely encrypted and used only with proper consent

Data transmission between systems uses industry-standard security (e.g., HTTPS, OAuth, or API tokenization)

You are responsible for ensuring that any third-party system you authorize does not send or trigger SMS messages that are unregistered, SHAFT-related, spammy, or in violation of telecom compliance rules.


11.4 Examples of A2P-Relevant Third-Party Situations

To give practical context:

If you use Zapier to connect a non-GotAI form to our SMS system, you must ensure the contact opted in for SMS.

If you send appointment reminders via a Google Calendar integration, you are responsible for making sure the contact agreed to receive SMS reminders from your number.

If you embed a Typeform into your website that sends contacts into GotAI, you must include SMS consent language in that form.

These third-party workflows must mirror A2P registration protocols, and all numbers must be registered under a valid campaign.

11.5 Termination of Third-Party Services

We reserve the right to remove or disable access to any Third-Party Service at any time, without notice, if:

The provider violates compliance standards or becomes unsecure

The service enables abuse, SHAFT messaging, or spam

A telecom carrier or compliance body flags traffic from that integration

You agree to promptly disconnect any third-party tools if notified by GotAI that they are no longer permitted under your usage agreement.

11.6 Your Responsibility

You agree to:

Comply with all third-party service terms of use

Ensure that any opt-ins collected through third-party tools meet CTIA, TCPA, and A2P requirements

Accept that third-party tools are not owned by GotAI, and therefore, any disputes or data issues should be directed to the third-party provider directly

12. Disclaimers

12.1 Services Provided “As-Is”

GotAI and all of its associated tools, platforms, features, and communications (including but not limited to CRM automations, AI assistants, booking integrations, SMS/email systems, and third-party connections) are provided "as is" and "as available" without warranties of any kind.

We expressly disclaim all warranties—express or implied—including but not limited to:

Merchantability

Fitness for a particular purpose

Non-infringement

Accuracy or reliability of results

Compatibility with all devices or systems

Uninterrupted or error-free operation

You acknowledge that software-based systems (especially those that automate SMS or digital communication) are inherently subject to occasional issues including delays, misrouted messages, or third-party downtime.

12.2 No Guarantee of Results

While GotAI offers tools that may assist with client reactivation, automation, lead generation, and marketing processes, we do not guarantee specific outcomes such as:

Increased revenue

Improved conversion rates

Guaranteed lead responses

Booking completions

Engagement through SMS or email channels

Any examples of performance metrics are illustrative only and not promises of actual results.

12.3 SMS Delivery Not Guaranteed

Although we utilize carrier-approved A2P 10DLC registration, we cannot guarantee that:

Messages will be delivered on time

All contacts will receive messages

All mobile carriers will accept or pass messages through

Recipients will open or interact with the content

Delivery can be affected by carrier filtering, user opt-out preferences, invalid phone numbers, mobile device settings, or upstream service disruptions. These are outside of our control and not covered under any form of liability or service level agreement.

12.4 System Maintenance and Downtime

Occasionally, GotAI (or integrated third-party providers) may experience:

Scheduled maintenance

Temporary outages

Feature malfunctions

Latency in automation triggers

We make reasonable efforts to minimize disruptions, but we do not guarantee uninterrupted access. You agree that your use of the platform may be subject to such technical fluctuations, and that we will not be liable for downtime or delayed communication unless otherwise agreed in a separate SLA.

12.5 A2P Regulatory Compliance Responsibility

While GotAI adheres to telecom industry best practices, including CTIA guidelines, TCPA regulations, and A2P 10DLC carrier registration, compliance is a shared responsibility.

You must ensure that your use of the platform (especially SMS/MMS tools) is compliant with the regulations in your region or industry.

This includes ensuring that your recipients have opted in to receive messages and that your content does not violate SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco) rules.

GotAI provides you with the tools, but how you use them is your responsibility. Failure to follow compliance requirements may result in carrier penalties, blocked messages, or suspension of services.

12.6 No Professional Advice

Nothing on the GotAI platform should be construed as legal, financial, or professional advice. If you are unsure whether your campaign, message content, or data usage is compliant, you should consult with a qualified professional.

13. Limitation of Liability

13.1 Maximum Liability Cap

To the fullest extent permitted by law, Revolutionary LLC (the company behind GotAI) shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages—even if advised of the possibility of such damages—arising from:

Your use or inability to use our Services

Errors, omissions, or inaccuracies within the platform

SMS/MMS delivery issues

Delays or interruptions in services or communications

Loss or corruption of data

Unauthorized access to or alteration of your transmissions or data

Third-party integrations or services

Regulatory actions or fines due to improper use of SMS tools

In any and all cases, our total liability to you shall not exceed the total amount paid by you to us for Services in the six (6) months preceding the event that gave rise to the claim.

13.2 No Liability for SMS Non-Delivery or Carrier Filtering

You acknowledge and agree that GotAI leverages carrier-approved A2P 10DLC SMS messaging routes but does not control:

Mobile carrier systems

Spam filters

Recipient opt-out behavior

Third-party SMS delivery partners

Therefore, we shall not be held liable for undelivered or delayed messages, including any business or revenue losses resulting therefrom.

13.3 Third-Party Services Disclaimer

GotAI may integrate or depend on third-party platforms such as:

Payment processors

Calendar tools (e.g., Google Calendar)

Email or SMS delivery services

AI engines or chat providers

Web tracking and analytics tools

We do not control, and shall not be responsible or liable for, the functionality, security, reliability, or privacy policies of any third-party service—even if accessed through our platform.

Any issues or disputes arising from third-party services must be addressed directly with those providers.

13.4 Assumption of Risk

By using the Services, you expressly acknowledge and agree that:

You assume full responsibility for the results of using the platform.

You understand the potential for miscommunication, timing errors, or regulatory complications (e.g., with SMS marketing).

You accept the risk that marketing campaigns or automations may not perform as expected.

13.5 Exceptions to Limitations

Some jurisdictions do not allow limitations of liability for personal injury, fraud, or certain types of negligence. In such cases, our liability will be limited only to the extent permitted by law in that jurisdiction.

14. Governing Law

14.1 Jurisdiction and Venue

These Terms of Service, along with any dispute, claim, or controversy arising from your use of GotAI or any related services, shall be governed and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.

By using our Services, you irrevocably consent that:
